Terms of Service, Refund Policy and Privacy Policy

Part 1. Terms of Service

1. Who we are

These Terms are an agreement between you and the seller:

In these Terms, «we», «us» and «our» mean the seller. «You» means the person who buys the Product.

2. Agreeing to these Terms

By completing a purchase, you confirm that you have read and agree to these Terms, the Refund Policy (Part 2) and the Privacy Policy (Part 3). If you do not agree, please do not buy the Product.

You must be at least 18 years old, or have permission from a parent or legal guardian, to make a purchase.

3. What you are buying

The Product is a digital, self-paced, recorded mini-lecture. It includes:

a recorded video lecture;
the lecture slide deck (PDF);
a prompt bank (PDF);
a workbook (PDF);
a bonus story bank (PDF);
a moodboard image bank (shared via Google Drive).

The Product does not include live sessions, personal coaching, homework review, feedback, or community access, unless the sales page clearly says otherwise. It is not an accredited course and does not lead to a certificate or qualification.

We may update and improve the materials over time. Updates will not remove the core content you paid for.

4. Price and payment

The price is EUR 9, shown on the payment page at the time of purchase. Payment is processed by WayForPay; the amount may be charged in Ukrainian hryvnia at the exchange rate shown on the payment page, and your bank may apply its own conversion. The price is charged once. There is no subscription and no recurring charge.

Payments are processed by WayForPay, a third-party payment provider. We never see or store your full card details. Your bank may charge currency conversion or foreign transaction fees. These fees are set by your bank and are not controlled by us.

Prices include any taxes we are required to charge, unless the payment page states otherwise.

5. Delivery and access

Access is delivered immediately after successful payment, by email to the address you provide at checkout. The email contains links to the video lecture and all materials.

If you have not received the email within 24 hours, please check your spam folder and then write to info@ainfluencer.com.ua with your payment date and the name on the payment. We will fix the problem within 3 business days.

Lifetime access means access for as long as we continue to offer the Product. You can download and keep the PDF files. If we ever stop offering the Product, we will email you at least 30 days in advance so you can download the materials that are available for download.

You need an internet connection, an email address and the ability to open Google Drive links. Short interruptions caused by maintenance or by third-party platforms (email, video hosting, Google Drive) are not a breach of these Terms if we fix them within a reasonable time.

6. Your license to use the materials

All materials (videos, texts, slides, prompts, workbook, story bank, image selections and design) belong to us or are used by us with permission. They are protected by copyright.

When you pay, you receive a personal, non-exclusive, non-transferable license to use the materials for your own learning.

You may:

watch the lecture and use the materials as many times as you like;
use the prompts, techniques and ideas to create your own images and videos, including for commercial projects.

You may not:

share, resell, sublicense, upload, publish or give away the materials or the access links, in whole or in part, for free or for money;
post the materials in group buys, shared drives, chats or social media;
screen-record or copy the lecture for distribution;
use the materials to build your own course, lecture, prompt pack or other information product for sale;
redistribute the moodboard image bank as a set.

Content you create yourself using what you learned belongs to you, subject to the terms of the AI tools you used.

If you break these rules, we may end your access without a refund and take legal action where appropriate.

7. AI tools and third-party services

The Product teaches you to work with generative AI tools. Third-party tools are not included in the price. Tools such as Midjourney, Seedance, ChatGPT and similar services are separate products. You sign up for them and pay for them yourself, under their own terms.

We are not affiliated with these companies (unless we clearly say so in a specific case). We are not responsible for their prices, availability in your country, feature changes, content moderation, account bans or shutdowns.

AI tools change quickly. A prompt, setting or screen shown in the lecture may work differently later. This is not a defect of the Product.

AI output is unpredictable by nature. Your results depend on your skills, effort, chosen tools and their versions. We do not promise that you will get the same images or videos as in our examples.

You are responsible for what you create and publish, including respecting other people’s rights (such as image rights, copyrights and trademarks), platform rules, and any rules on labeling AI-generated content that apply to you.

8. No earnings or results guarantee

We do not guarantee any income, views, followers, viral reach or business results. Any numbers, case studies or results mentioned on the sales page, in our social media or in the materials describe our own experience or the experience of specific people. They are not typical results and are not a promise that you will achieve the same.

The Product is for education only. It is not legal, financial, tax or other professional advice.

9. Limitation of liability

The Product is provided «as is». To the extent permitted by law, our total liability to you for any claim related to the Product is limited to the amount you paid for it.

We are not liable for indirect losses, such as lost profits, lost data or lost opportunities, or for problems caused by your devices, your internet connection, payment providers, email services, Google Drive or third-party AI tools.

Nothing in these Terms limits any rights you have as a consumer that cannot be limited by law in your country of residence, or our liability for intentional misconduct or gross negligence.

We are not responsible for delays or failures caused by events outside our reasonable control, including war, air raid alerts, power outages and communication failures. Our business is based in Ukraine, and such events can affect our availability.

10. Ending access

We may suspend or end your access if you break Section 6 or use the Product in a way that harms us or others. In that case, no refund is due.

11. Changes to these Terms

We may update these Terms. The version that applied when you made your purchase governs that purchase, unless a newer version is more favorable to you.

12. Governing law and disputes

These Terms are governed by the laws of Ukraine. If you have a problem, please contact us first at info@ainfluencer.com.ua. Most issues can be solved quickly by email.

If a dispute cannot be solved by agreement, it will be decided by the competent courts of Ukraine. If you are a consumer living in the EU or another country, you keep the protection of the mandatory consumer laws of your country of residence, and you may also be able to bring a claim in the courts of your country.

13. Other terms

If any part of these Terms is found invalid, the rest stays in force. If we do not enforce a right immediately, we do not give it up. These Terms, together with the Refund Policy and Privacy Policy, are the full agreement between you and us about the Product.

The Ukrainian-language public offer for this Product is published at https://ainfluencer.com.ua. For international customers who buy in English, this English version applies.

Part 2. Refund Policy

No refunds after access, with clear exceptions

Because the Product is digital content delivered instantly, all sales are final once access has been delivered, except in the cases below.

You are entitled to a full refund if:

you paid but did not receive access, and we did not fix the problem within 3 business days after you contacted us;
you were charged twice for the same Product (we refund the duplicate payment);
the materials are materially different from the description on the sales page, and we did not fix this within 7 days after you contacted us;
a refund is required by the mandatory law of your country.

Refunds are not given because you changed your mind, did not watch the lecture, cannot or do not want to pay for third-party AI tools, or did not get the results you hoped for.

How to request a refund

Email info@ainfluencer.com.ua with:

the email address you used at checkout;
the date of payment;
the reason for your request.

We reply within 7 business days. Approved refunds are sent back through WayForPay to the original payment method. Your bank may need 5 to 15 business days to show the money in your account. We cannot refund bank fees or currency conversion losses charged by your bank.

Please contact us before opening a chargeback or payment dispute. We are a small team and will solve real problems quickly.

EU and UK customers: right of withdrawal

Under EU and UK consumer law, you normally have 14 days to withdraw from an online purchase. For digital content that is not supplied on a physical medium, this right ends once the supply of the digital content has begun with your prior express consent and your acknowledgment that you lose the right of withdrawal.

At checkout we ask you to confirm the following statement. Your access starts only after this confirmation:

After your purchase, we send you a confirmation email that repeats this consent and includes these Terms. This email is your record of the agreement.

If you have not received access yet, you can still withdraw and get a full refund by emailing us.

Part 3. Privacy Policy

1. Who is responsible for your data

The data controller is FOP Baum Anna Andriivna, Ukraine (contact details in Part 1, Section 1). For any privacy question or request, email info@ainfluencer.com.ua.

2. What data we collect

Contact data: your name and email address, which you give us at checkout or when you message us.
Purchase data: what you bought, the date, the amount and the payment status. We receive this from WayForPay. We never receive your full card number. Card data is handled by WayForPay under its own privacy policy.
Messaging data: if you contact us on Instagram (@ai.na.baum), we receive your Instagram username and the messages you send. Automated replies on Instagram are handled by ManyChat.
Support data: the content of emails you send us.
Website data: our website uses cookies and similar technologies, including the Meta Pixel, to measure visits and the performance of our ads. You can control cookies in your browser settings.

3. Why we use your data, and our legal basis

We do not sell your personal data.

4. Who we share data with

We share only what each service needs to do its job:

WayForPay (payment processing);
our email and website platform (SendPulse) (sending access emails and newsletters, hosting the site);
Google (Google Drive, for the image bank links);
Meta Platforms (Instagram messaging, Meta Pixel);
ManyChat (automated Instagram messages);
Telegram (if you contact us through our Telegram bot);
accountants or authorities, when required by law.

5. International transfers

We are based in Ukraine. If you live in the EU, the UK or the US, your data is processed in Ukraine and by service providers in other countries, including the US. Where data leaves the EU, it is transferred because it is necessary to perform our contract with you (Article 49(1)(b) GDPR) or under the safeguards offered by the service provider, such as Standard Contractual Clauses.

6. How long we keep your data

Purchase and payment records: as long as Ukrainian tax and accounting law requires.
Contact data for delivering the Product: as long as you have access to the Product, or until you ask us to delete it.
Newsletter data: until you unsubscribe.
Support messages: up to 2 years after the last message, unless needed for a dispute.

7. Your rights

Depending on where you live (including under the GDPR), you have the right to:

access a copy of your data;
correct inaccurate data;
delete your data («right to be forgotten»);
restrict or object to processing;
receive your data in a portable format;
withdraw consent at any time (this does not affect processing done before);
complain to your local data protection authority.

To use any of these rights, email info@ainfluencer.com.ua with the subject «Privacy request». We reply within 30 days. If you ask us to delete your data, we may still keep payment records that the law requires us to keep, and you may lose access to the Product if we can no longer send you access emails.

US residents: we do not sell or share personal information for cross-context behavioral advertising beyond the use of the Meta Pixel described above. You can opt out of non-essential cookies through your browser settings.

8. Unsubscribing

Every marketing email contains an «Unsubscribe» link. You can also email us. Messages that relate to your purchase (access links, receipts) are not marketing and are sent even if you unsubscribe from news.

9. Security

We use reputable providers and limit access to your data. No system is completely secure. If you notice a problem, please tell us right away.

10. Children

The Product is not intended for children under 16. We do not knowingly collect data from children. If we learn we have, we delete it.

11. Changes

We may update this Privacy Policy. The «Last updated» date at the top shows the latest version.
